En t\u00e9rminos generales, se advierte que el desarrollo de las relaciones comerciales entre ambas naciones ha ido en aumento, sobre todo en a\u00f1os recientes, impulsado en gran medida por virtud de lo previsto en el Tratado de Libre Comercio entre M\u00e9xico y la Uni\u00f3n Europea.<\/p><p><br><\/p>\n<p><\/p>\n<p><strong>Datos estad\u00edsticos relevantes de Espa\u00f1a.<\/strong><\/p>\n<p><\/p>\n<p>Teniendo en cuenta lo se\u00f1alado por el Portal Expansi\u00f3n, entre algunos datos estad\u00edsticos relevantes de dicho pa\u00eds, se tienen a saber:<\/p><p><br><\/p>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Espa\u00f1a se ubica en el sur de Europa y cuenta con una superficie de 505.957 kil\u00f3metros cuadrados.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Tiene una poblaci\u00f3n de 47.432.805 personas y se encuentra en la posici\u00f3n 30 de la tabla de poblaci\u00f3n a nivel internacional, compuesta por 196 pa\u00edses, presentando una moderada densidad de poblaci\u00f3n de 94 habitantes por km2.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Su capital es la Ciudad de Madrid y la moneda empleada son los Euros.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>En el a\u00f1o 2021, a nivel mundial, se encuentra ubicada como la econom\u00eda n\u00famero 14 por volumen de su Producto Interno Bruto (PIB), curiosamente un lugar arriba de M\u00e9xico.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Cuenta con una deuda p\u00fablica de 1.427.235 millones de euros y una deuda del 118,4% de su PIB.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Su deuda per c\u00e1pita es de 30.090 euros por persona.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>La \u00faltima tasa de variaci\u00f3n anual del \u00cdndice de Precios al Consumidor (IPC) publicada en Espa\u00f1a y que corresponde al mes de agosto de 2022 fue del 10,4%.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>En la actualidad tiene una alta tasa de desempleo.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>El PIB per c\u00e1pita en el caso de Espa\u00f1a en el 2021 fue de 25.460 euros, ubic\u00e1ndose en el puesto 36 de 196 pa\u00edses del ranking mundial de PIB per c\u00e1pita.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>En cuanto al \u00cdndice de Desarrollo Humano (IDH) que elabora la Organizaci\u00f3n de las Naciones Unidas, se desprende que los espa\u00f1oles cuentan con una buena calidad de vida.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Se encuentra en el 30\u00ba puesto de 190 de los pa\u00edses que conforman el ranking Doing Business, el cual clasifica a los Estados atendiendo a la facilidad que se ofrece para realizar negocios.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<\/li><ul>\n<li>Por lo que respecta al \u00cdndice de Percepci\u00f3n de la Corrupci\u00f3n del sector p\u00fablico en Espa\u00f1a, es de 61 puntos, as\u00ed pues, los habitantes de aqu\u00e9l pa\u00eds tienen un bajo nivel de percepci\u00f3n de la corrupci\u00f3n gubernamental.<\/li>\n<\/ul>\n\n<\/ul><div><font face=\"-apple-system, BlinkMacSystemFont, Segoe UI, Roboto, Oxygen-Sans, Ubuntu, Cantarell, Helvetica Neue, sans-serif\"><br><\/font><\/div>\n<p><\/p>\n<p><\/p>\n<ul>\n<li>Entre algunos datos relevantes, en relaci\u00f3n con los negocios y el comercio en que las relaciones comerciales entre los dos pa\u00edses, atendiendo a lo se\u00f1alado por el Banco de M\u00e9xico, por el Instituto Nacional de Estad\u00edstica y Geograf\u00eda y por la Secretar\u00eda de Econom\u00eda<\/span><span style=\"font-weight: 400;\">, cuentan con la siguiente informaci\u00f3n:<\/span><\/p>\n<p><!-- \/wp:paragraph Las importaciones espa\u00f1olas de productos mexicanos ascendieron a 4.059 millones de euros, un aumento del 18% en comparaci\u00f3n con 2016. Su composici\u00f3n se caracteriza por estar poco diversificada, puesto que en un amplio porcentaje se centra en los combustibles, que supusieron en 2017 el 65% de todo el volumen importado. Otros productos destacados son aparatos y maquinaria mec\u00e1nica, veh\u00edculos, aparatos \u00f3pticos, maquinaria el\u00e9ctrica y minerales. Tambi\u00e9n son notables las importaciones de productos agroalimentarios (aguacates, hortalizas, caf\u00e9, cerveza, pescado). text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">El comercio internacional existente entre ambas naciones se sustenta en varios instrumentos que son a saber: el Tratado de Libre Comercio entre M\u00e9xico y la Uni\u00f3n Europea (UE), el cual entr\u00f3 en vigor desde el mes de julio del a\u00f1o 2000, igualmente puede citarse por su inter\u00e9s la suscripci\u00f3n del Acuerdo para la promoci\u00f3n y protecci\u00f3n rec\u00edproca de inversiones entre los Estados Unidos Mexicanos y el Reino de Espa\u00f1a, as\u00ed como el Convenio entre los Estados Unidos Mexicanos y el Reino de Espa\u00f1a para evitar la doble imposici\u00f3n en materia de impuestos sobre la renta y el patrimonio y prevenir el fraude y la evasi\u00f3n fiscal, instrumentos legales e internacionales que sirven para regular el comercio y las operaciones comerciales en los pa\u00edses en estudio.<\/span><\/p>\n<p><b style=\"font-weight: normal;\"><\/b><\/p>\n<p><b style=\"font-weight: normal;\"><br>\n<\/b><\/p>\n<p><b style=\"font-weight: normal;\"><\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: bold; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Tratado de Libre Comercio entre M\u00e9xico y la Uni\u00f3n Europea (UE).<\/span><\/p>\n<p><b style=\"font-weight: normal;\">&nbsp;<\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">El sustento jur\u00eddico de la relaci\u00f3n comercial entre Espa\u00f1a y M\u00e9xico, se basa fundamentalmente atendiendo a lo establecido en el Tratado de Libre Comercio entre M\u00e9xico y la Uni\u00f3n Europea (UE), tratado que desde el a\u00f1o 2000 contin\u00faa siendo vigente, y los documentos que conforman el mismo son a saber: el Acuerdo de Asociaci\u00f3n Econ\u00f3mica, Concertaci\u00f3n Pol\u00edtica y Cooperaci\u00f3n entre la Comunidad Europea y sus Estados Miembros, por una parte y los Estados Unidos Mexicanos, por la otra; la Decisi\u00f3n No. 2\/2000 del Consejo Conjunto CE \u2013 M\u00e9xico de fecha 23 de marzo de 2000 y la Decisi\u00f3n No. 1\/2000 del Consejo Conjunto CE \u2013 M\u00e9xico del 23 de marzo de 2000.<\/span><\/p>\n<p><b style=\"font-weight: normal;\">&nbsp;<\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">En otro art\u00edculo publicado en esta misma revista, tuvo la oportunidad de examinar y analizar diversos aspectos del comercio entre M\u00e9xico y la Uni\u00f3n Europea, y en el mismo se observ\u00f3 el contenido del proyecto del nuevo Tratado comercial de M\u00e9xico con la Uni\u00f3n Europea, negociaci\u00f3n que comenz\u00f3 en el mes de junio de 2016 y de la cual se sabe concluyeron negociaciones en el a\u00f1o de 2020, cabe hacer menci\u00f3n que de este nuevo tratado falta por ser aprobado por todas las autoridades competentes de cada uno de los pa\u00edses participantes en la nueva negociaci\u00f3n<\/span><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">, por lo que se sugiere al lector para una mayor comprensi\u00f3n del tema examinar el art\u00edculo de referencia.<\/span><\/p>\n<p><b style=\"font-weight: normal;\">&nbsp;<\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Acuerdo para la promoci\u00f3n y protecci\u00f3n rec\u00edproca de inversiones entre los Estados Unidos Mexicanos y el Reino de Espa\u00f1a.<\/span><\/p>\n<p><b style=\"font-weight: normal;\">&nbsp;<\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Para efectos del acuerdo de referencia una inversi\u00f3n significa, entre otros aspectos, los activos propiedad de, o bien que est\u00e9n controlados por inversionistas de alguno de los pa\u00edses del propio acuerdo, y una inversi\u00f3n puede referirse a: una empresa; acciones; partes sociales, as\u00ed como a otras formas de participaci\u00f3n del capital en una empresa; instrumentos de deuda de una empresa; un pr\u00e9stamo, etc.&nbsp;<\/span><\/p>\n<p><b style=\"font-weight: normal;\">&nbsp;<\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">En este contexto, se indica que cada pa\u00eds parte del acuerdo deber\u00e1 otorgar en su territorio a las inversiones del otro pa\u00eds, un tratamiento que deber\u00e1 ser no menos favorable que el otorgado a sus propios inversores, por ende, cada Estado deber\u00e1 conceder un tratamiento no menos favorable que el otorgado, en circunstancias similares, a sus propios inversores o a inversores de cualquier tercer Estado. Tambi\u00e9n debe tenerse en cuenta que cada naci\u00f3n deber\u00e1 conceder a las inversiones del otro Estado un trato acorde con el derecho internacional consuetudinario, lo cual incluye un trato justo y equitativo, as\u00ed como protecci\u00f3n y seguridad plenas para los inversionistas.&nbsp;<\/span><\/p>\n<p><b style=\"font-weight: normal;\"><\/b><\/p>\n<p><b style=\"font-weight: normal;\"><br>\n<\/b><\/p>\n<p><b style=\"font-weight: normal;\"><\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: bold; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Convenio entre los Estados Unidos Mexicanos y el Reino de Espa\u00f1a para evitar la doble imposici\u00f3n en materia de impuestos sobre la renta y el patrimonio y prevenir el fraude y la evasi\u00f3n fiscal.<\/span><\/p>\n<p><b style=\"font-weight: normal;\">&nbsp;<\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2; text-align: justify; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 12pt; font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Con respecto a este convenio, se observa que el mismo aplicar\u00e1 a los impuestos sobre la renta y sobre el patrimonio exigibles por cada pa\u00eds, con independencia del sistema de exacci\u00f3n fiscal que se utilice. Para efectos del mismo, se consideran impuestos sobre la renta y sobre el patrimonio aqu\u00e9llos que gravan la totalidad de la renta, del patrimonio o cualquier parte de los mismos, incluidos los impuestos sobre las ganancias derivadas de la enajenaci\u00f3n de los bienes muebles o inmuebles, as\u00ed como de los impuestos sobre las plusval\u00edas. El acuerdo de referencia contempla y regula conceptos tales como: la noci\u00f3n de residentes, establecimiento permanente, rentas inmobiliarias, beneficios empresariales, navegaci\u00f3n mar\u00edtima y a\u00e9rea, empresas asociadas y dividendos, entre otros rubros.<\/span><\/p>\n<p><b style=\"font-weight: normal;\"><\/b><\/p>\n<p><b style=\"font-weight: normal;\"><br>\n<\/b><\/p>\n<p><b style=\"font-weight: normal;\"><\/b><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.2;
